2013年10月17日下午三点，由网投十大信誉排名劳动法与社会保障法研究所和网投十大信誉排名经济法研究所联合主办的“北大社会法论坛”第20期在北大法学院凯原楼303会议室成功举行。本期论坛是题为“劳动法的经济分析”的讲座，由美国康奈尔大学法学院院长Stewart J. Schwab教授主讲。论坛由北大法学院凌斌副教授主持，北大法学院叶静漪教授、康奈尔大学法学院於兴中教授、北大法学院郭雳教授、中国社会科学院法学研究所谢增毅副研究员和中央财经大学法学院李海明讲师出席了此次论坛，北大法学院的法学硕士生、法律硕士生和本科生数十人到场聆听。
Schwab教授追溯了自胡适先生以来的网投十大信誉排名的优良学术传统和思想氛围，对此给予了高度的赞赏，然后，正式开始讲座。Schwab教授开宗明义，首先和大家分享了他对劳动法、经济分析等概念的理解，并对相关概念进行了区分。然后以休假及其时间长短、工作环境、职业稳定的保障、离职评价等内容为切入点，通过丰富详实的案例和事实，介绍了劳动法中体现的效率，阐明了劳动法和效率的良性的互动关系，在这一过程中，在场的嘉宾和同学积极参与，从雇主和雇员的不同立场作出选择，共同完成了一个经济分析的过程，给大家留下深刻的印象。Schwab教授奉献了一场内容丰富、叙事流畅、逻辑清晰、条理分明、有理有据的精彩学术盛宴。
在点评互动阶段，於兴中教授、叶静漪教授、郭雳教授、谢增毅副研究员以及李海明讲师先后进行了点评。几位老师充分肯定了从法律经济学的视角对劳动法进行研究的学术价值，指出我国劳动法侧重在立法中给予劳动者全面保护，对于劳动法中的市场、效率和价值的讨论则略显不足。Schwab教授对各位老师的点评进行了回应，并详细耐心地解答了同学们的提问。在智慧的火花不断撞击出的热烈学术氛围中，论坛持续了近3个小时，圆满谢幕。

Professional Biography
Stewart J. Schwab was appointed the Allan R. Tessler Dean of Cornell Law School on January 1, 2004. He has been a member of the Cornell Law School faculty since 1983. A native of North Carolina, he obtained his J.D. as well as a Ph.D. in Economics from the University of Michigan. After Law School, Dean Schwab clerked for Judge Phillips of the U.S. Court of Appeals for the Fourth Circuit, and then for Justice Sandra Day O‘Connor of the U.S. Supreme Court. Dean Schwab is a leading scholar in economic analysis of law and in employment law. He is currently a Reporter for the American Law Institute’s Restatement of Employment Law, and in 2008 was named by Human Resource Executive as one of the 50 most powerful employment attorneys in America. Professor Schwab is a popular teacher, having taught many courses in the curriculum, including Torts, Contracts, Corporations, Employment Law, Labor Law, and Empirical Legal Studies, among others.
